Course Objective

The lesson aims to introduce students to the principles and process of the Turkish collective bargaining system which regulated in The Syndicates and Collective Labour Agreement Act numbered 6356 .

Learning Outcomes of the Course Unit

1   Being able to gain knowledge and understanding of the legal system of Turkish Syndicates and Collective Labour Agreement law
2   Being able to formulate and evaluate simple legal arguments
3   Being able to show some ability to analyse the existing law critically.
4   Being able to learn to define and use legal terms and concepts related to collective bargaining
5   Being able to learn about the distinctions between collective labour agreement, collective bargaining and individual agreement
6   Being able to describe the stages involved in Turkish Collective Bargaining process
7   Being able to apply the major rules in solving problem questions in Collective Labour Agreement Law

2 Effects, duration and expiry of a collective labour agreement;Extension procedure of collective labour agreement
3 Conclusıon of collectıve labour agreements : application procedure for determining competence
4 Disputes as to competence; certificate of competence
5 Invitation to collective bargaining; the competent authority
6 Commencement of collective bargaining; conclusion of a collective labour agreement, signature and submission
7 Dısputes and medıatıon
8 Definition of strike, lawful strike, unlawful strike,lock-out,lawful lock-out and unlawful lock-out; Decision to call a lawful strike or order a lawful lock-out
9 Prohıbıtıon and suspensıon of strıkes and lock-outs; Recourse to the High Court of Arbitration in the event of prohibitions ;Strike ballot
10 Commencement of a strike or lock-out
11 Consequences of strike or lock-out(part 1)
12 Consequences of strike or lock-out(part 2)
