Course Objective

The purpose of the course is to teach the meaning, scope and practice of medical criminal law, which is emerged as a sub branch of criminal law.

Learning Outcomes of the Course Unit

1   To be able to have knowledge of the meaning and scope of medical crimanal law.
2   To be able to learn the relation between medical criminal law and criminal law.
3   To be able to deeply examine the types of crimes in the field of medical criminal law.
4   To be able to consider the function of medical criminal law in the matter of struggle of the risks caused in the medical field.
5   To be able to implement the basic principles of the criminal law and the rules of criminal theory into the concrete facts related to crimes appeared in the field of medicine.
6   To be able to deliver a solution for the problems arised from the operation of criminal procedure regarding medical criminal law.
7   To be able to have an opinion about the recent developments in medical criminal law in comparative law systems.

Course Contents

1 The meaning and scope of medical criminal law
2 The relation between medical criminal law and criminal law
3 Disclosure obligation of doctor, consent for medical intervention and conditions for lawful consent
4 Notion of fault in medical criminal law and its practice
5 Causality in faulty medical treatment of a doctor and the problem of objective attribution
6 Hypothetical consent in medical criminal law as a cause of legitimacy
7 Midterm
8 Consideration of off-label medical interventions such as cosmetic surgery with regards to consent in medical criminal law
9 The effect of density of working hour of a doctor to the criminal liability
10 Punishability of medical intervention of a doctor in regard to crimes of malicious wounding and wilful murder
11 Avoidance of a doctor from medical treatment as a negligent action in criminal law
12 The limits of confidentiality obligation of a doctor
13 The crime of organ and tissue trade
14 The crime of experimentation on human beings
