Course Objective

The aim of the course is to examine the role of the indictment and prosecutors in criminal proceedings.

1   to apprehend the function of indictment in criminal procedure
2   to understand the status and functions of prosecutors in criminal procedure
3   to evaluate the criminal procedure mechanism
4   to understand how the dismissal of the indictment works
5   to internalize due process and right to fair trial

1 Prosecutor's Office
2 Principle of compulsory public prosecution
3 Prosecutor's monopolised power to open open main proceedings (to bring criminal charges to court) and exceptions to this power
4 The relationship between the indictment and right to fair trial
5 The status of the prosecutor regarding the new prosecutor model of the Criminal Procedure Code
6 Indictment's functions to limit, notify, and filtre
7 Midterm
8 The status and the rights of the suspect in investigation procedure and the problem of his/her ability to influence indictment preparation process
9 The meaning of the terms sufficient doubt and sufficient evidence in indictment
10 Suspension of the main trial
11 Dismissal of the indictment
12 The relationship between the evidence obtained via confidential investigation measures and illegal evidence obtained at the investigation procedure
13 Preventive policing and its effects on the indictment preparation
14 The change of the qualification of the charged crime at the main trial and its relation to additional indictment (Turkish Criminal Code Article 225-226)
