Course Objective

To explain the general principles of Ottoman land law, to determine the types of land and the legal consequences related to it; to examine the concept of property in Ottoman land law by examining in detail the mîrî land and timar system within the scope of örfî law and to explain how the deterioration in the Ottoman land order took place after the Tanzimat period.

Learning Outcomes of the Course Unit

1   To recognize the basic concepts and institutions related to Ottoman land law
2   To be able to explain the effects of the Mîrî land system in Turkish legal history
3   To be able to specify the land types in the Land Law of 1858
4   To be able to reveal the importance of the concepts of tefviz, tasarruf and ferağ in Mîrî land
5   To be able to determine the difference of inheritance transfer rules in Mülk land and Mîrî land
6   To be able to explain the deterioration in Ottoman land order after Tanzimat period

3 Property concept of Islamic Law, concepts of rakabe, yed and tasarruf
4 Codification of the law of the land in the Ottoman Empire
5 Mîrî land regime and Tımar system
6 Types of mîrî land, its formation, the enactment of the law of mîrî land in the Ottoman State
7 Description of tımar, the state's right on land subject to the tımar system, types of tımar
8 Midterm
9 Description of the tefviz and the parties of it, the nature of the right acquired by the mutasarrıf
10 Tasarruf in the Mîrî land, the tasarruf principle accepted by the Land Law
11 The ferağ of Mîrî land
12 Transfer of Mîrî land and mülk agricultural lands
13 Priority purchase right in transfer of Mîrî land
14 Disruption of Ottoman land order, signs of corruption in order
