Course Objective

The parties can apply one of the methods to solve the disputes raised upon international commerce. These methods are to solve international disputes by national courts, by commercial arbitration and alternative remedy. The purpose of this lesson is to give information about these mehods and how to solve the disputes rised upon international commerce by using these methods.

Learning Outcomes of the Course Unit

1   to express information about Turkish competent jurisdiction system relating to solve international disputes by national courts
2   to explain competent agreement and solving the international commerce disputes by courts which are chosen by the parties
3   to clarify the concept of international arbitration in solving the international commerce disputes by commerical arbitration
4   to identify international agreements and the legal regulations about enforcement of arbitral awards
5   to classify the methods of alternative remedy

1 Competent jurisdiction system in general
2 Competent Turkish courts chosen by parties' agreement
3 The conditions for the agreement's adjective and subsidantive clauses which provides competence to Turkish court
4 The delimitations about competence agreements
5 The conditions for the agreement which makes result to provide foreign courts competence
6 Exclusive competence of chosen foreign court and besides competence agreements the situations of Turkish courts may have competence judgement.
7 International commerce arbitration in general
8 Midterm exam
9 The sources of international arbitration in Turkish law
10 To solve investment disputes which the state and public authorities became party, by arbitration.
11 International agreements and legal regulations about enforcement of arbitral awards
12 The fact that there isn't any International arbitration centrum in Turkey
13 The meaning of alternative remedy
14 Alternative remedy in general
