Course Objective

To analyse tripartite labor relations that are encountered for public services (sub contracting practice, outsourcing, office transfer, loaned business relationship), to identify results and provisions and to specify the problems seen in practice.

Learning Outcomes of the Course Unit

1   To analyse sub contracting practice, office transfer, loaned business relationship in public administration.
2   To identify problems about individual and collective labor relation.
3   To solve these kind of problems.
4   To work in the direciton of scientific reviews and subsidiary discipline principles.
5   To understand the reasons and effects of tripartite labor relations in public services.

Course Contents

1 Service procurement agreement in public administration, Evaluation of process that is required to be transferred to third parties
2 Definition of Subcontracting, its legal elements, separation between main-subsidiary labor.
3 Legal status of subcontractor laborers, results of violation of legal restrictions in terms of personnel labour relations, the responsibility of main employer
4 Evaluation of subcontracting relation in terms of collective relations, unionization of subcontractor laborers, analyze of business line.
5 Benefit from collective labour agreement.
6 Job security in subcontracting relation, reemployment lawsuit and qualifications.
7 Midterm
8 Effect of protection against dissolution on labour relation, responsibility of main employer about the results of reemployment lawsuit
9 Problems of application of sub-contractor in public sector and solutions.
10 Legal status and precedents in terms of public procurement statute
11 Transfer relations between public agencies, business transfer and individual transfer of labor relationship, circumstances.
12 Judgments and results of period, it effects on labourer priority and labourer
13 Individual transfer of labour agreement, triple consensus, and effects of period to labour relations.
14 Loaned (temporary) labour relation in public administration, cognitive appraisal and legal provisions, results of loaned (temporary) labour relation, responsibility of administration.
