Course Objective

This course aims to explain how and why state interventions are set forth by competition policies and drafted competition acts and restrictions in order to constitute an open market which provides maximum benefit for consumers and social welfare, competitors as well.

Learning Outcomes of the Course Unit

1   To state the reasons (aims) and scope of the legal instruments of competition law
2   To state competition theories; how competition is prevented, restricted or distorted
3   To understand the meaning of agreements, decisions and practices preventing, restricting or distorting competition
4   To determine why an exemption regime has been regulated and to explain the types and conditions of exemption
5   To explain the meaning of abuse of dominant position and to state the elements (forms) of dominant position
6   To state the substantial and procedural conditions for a merger or an acquisition not in breaching competition rules
7   To state the sanctions of any practice or transaction preventing, restricting or distorting competition

1 Basic information on competition law as a subsidiary field of economics law
2 The aim of the protection of competition, resources and scope of the competition rules
3 Prohibition of cartelization and other forms of restricting competition; conditions for any prevention
4 Agreements, decisions and practices limiting competition between undertakings
5 Doctrinal interpretation of some concepts: prevention, restriction, distortion of competition, aim and effect of such agreement, decision or practice
6 Concept of exemption, reasons for an exemption regime. Conditions of individual and block exemptions
7 Concept and conditions of abuse of dominant position, restrictions on prohibition of abuse of dominant position
8 Midterm exam
9 Midterm exam
10 Concepts of merger and acquisition, procedures and types of mergers and acquisitions restrictions on mergers and acquisitions
11 Examples of relationship between competition law and intellectual property law
12 Sanctions of such act or transaction violating competition rules in comparison with Turkish and European Law; procedures followed by Turkish Competition Authority in investigations and examinations
13 Decisions of Turkish Competition Authority, consequences of violation of competition with private law aspects
14 General review with in terms of some principle decisions of Turkish Competition Authority
