Course Objective

This course aims to introduce conflict of laws and Turkish Code on Private International Law and International Civil Procedure. The course will focus on conflict of laws rules, international civil procedure, and international commercial arbitration.

Learning Outcomes of the Course Unit

1   demonstrate understanding of main issues, legal concepts and rules of international private law in order to identify the legal issues.
2   be able to follow the current changes in the field in order to discuss the relevant topics.
3   be able to acquire the skills to work as a team.

2 Conflict of laws, connecting factors, classification, renvoi, preliminary question
3 Fraus legis, public policy, the application of foreign law
4 The Code of Private International Law and International Civil Procedural Law; Conflict of laws rules relating to law of persons
5 Conflict of laws rules relating to law of family and law of inheritance
6 Obligations arising from contracts
7 Torts
8 International jurisdiction of Turkish Courts
9 Agreement on jurisdiction and its Limitations
10 Recognition and enforcement of foreign court judgements
11 International arbitration and alternative dispute resolutions
12 Enforcement of foreign arbitral awards
