Course Objective

The purpose of this course is to help the students, who will take during the third and fourth semester Law of Obligations Course, which is very comprehensive and hard, to success through providing a basis for this compulsory course.

1   To recognize the mainly principles which influence the Law of Obligations 2   Be aware of the differences between the sources of the obligations and their results 3   To comprehend the content of the obligation relationship 4   To understand the effect of the legal transactions on the asset

Course Contents

Week Subject Description 1 Introduction to Law of Obligations Definition of the Law of Obligation, its place according to the other law sections and its importance, its function and mainly principles which influence the Law of Obligation. 2 Obligation Relationship (Obligation in a broad sense) Parties, content, sources, termination of the obligation relationship and especially its diference from the obligation in the strict sense 3 Concepts of duty, obligation, deed, burden, liability The places of these concepts according to the eachother, their similarities and differences 4 Credit and the related rights, claim 5 imperfect obligations Concept of the imperfect obligations and the most common types of them in our Law of Obligations, espacially prescription. 6 Obligations arive from legal transactions Consept of the legal transaction and its elements, especially decleration of intention 7 Obligations arive from legal transactions Legal transactions according to their effects on the asset (obligatory-dispositive-acquisitive transactions and diference between real rights and personal rights) 8 Obligations arive from legal transactions Legal grounds of acquisitive transactions, difference between legal ground and motive, situations, in which the content of motive is important in the Law of Obligation 9 Obligations arive from legal transactions Concluding of contractions (Offer, invitation to an offer, acceptance- general terms of transactions) 10 23rd April (official holiday) 11 Tort Elements of the liability from tort, types of objective liability 12 Midterm Exams Week 13 Midterm Exams Week 14 Performance, impossibility of the performance, failure of the performance and espaciailly default Parties, place, time of the performance; different apperances from failure of performance and their results, default of debtor and creditor 15 Special situations in obligation relationships Solidarity, conditions, bargain money-forfait money and espacially penal clause
