Course Objective

The course of Civil Law aims at studying in detail the general principles of law, basic rules of law, rules regulating the acquisition of personality and termination of personality in natural persons and legal entities, possession of rights and legal capacity, protection of personality, name and ways to protect the name, residential area and kinship relationships of natural persons, legal relationships between the individuals constituting the family which is the foundation of the society under the major topics of Preliminary Provisions, Law of Persons and Family Law.

Learning Outcomes of the Course Unit

1   Ability to explain the concept of Civil Law
2   Ability to associate the Preliminary Provisions and the general principles of law with the legal disputes/problems in the other branches of law
3   Ability to apply the law to the subjects included in the course of Civil Law
4   Ability to decide accurately what legal rule(s) to be applied in the issues to which rules of Civil Law are to be applied
5   Ability to apply any legal regulations in Civil Law to an event in the other branches of law as well as in Civil Law
6   Ability to identify any problems arising in practice due to the legislation in Civil Law
7   Ability to produce remedial suggestions for the problems arising in practice due to the deficiencies of the rules of Civil Law, considering the opinions in doctrine as well

1 Introduction; provision of general information on the object and contents of the course and materials related with the course
2 Introduction to Law; Definition of Right, Law and Civil Law, Sanction, Branches of Law, Legal Rules (Qualifications and Types of Legal Rules, Its Relation with and Differences from the Rules of Religion, Ethics, Manners and Customs). General Information on Civil Law (Subject, System, Resources of Civil Law, Former Civil Law).
3 Basic concepts of Civil Law: Concepts and types of Right, Acquisition of Rights; Legal Event, Legal Relationship, Legal Transactions and types thereof, Invalidity of Legal Transactions (Non-Existence, Absolute Nullity, Annulability, Incompleteness, Relative Nullity, Partial Nullity), Types of acquisition of rights,
4 Preliminary Provisions of Civil Code: Application of Civil Law (Application in Terms of Time and in Terms of Sense); Interpretation, Completion of the Code, Gap in Law and Filling the Gaps in Law, Discretion of Judge
5 Good Faith and prohibition on Exploitation of a Right. Goodwill Principle and Role of Goodwill (especially in the Acquisition of Rights)

In the course of Civil Law, the subjects are explained in the light of examples from the practice and especially decrees made by the Supreme Court and the Federal Courts and lectures are given in the form of case analyses.
