Course Objective

To explain the general principles of the Ottoman land law, to determine the types of land and legal consequences related to it; to examine the concept of property in Ottoman land law by examining in detail mîrî land and timar system within the scope of örfi law and to explain how the deterioration in the Ottoman land order took place after the Tanzimat period.

Learning Outcomes of the Course Unit

1   To recognize the basic concepts and institutions related to Ottoman land law
2   To be able to explain the effects of the miri land system in Turkish legal history
3   To be able to specify the land types in the Land Law of 1858
4   To be able to reveal the importance of the concepts of tefviz, tasarruf and ferağ in miri land
5   To be able to determine the difference of inheritance transfer rules in mülk and miri land
6   To be able to explain the deterioration in Ottoman land order after Tanizmat period

3 Property concept of Islamic Law, concepts of rakabe, yed and tasarruf Priority purchase right in transfer of miri land
4 Codification of the law of land in the Ottoman Empire Disruption of Ottoman land order, signs of corruption in order
5 Miri land regime and Tımar system
6 Types of miri land, its formation, the enactment of the law of miri land in the Ottoman State
7 Description of tımar, the state's right on land subject to the tımar system, types of tımar
8 Midterm
9 Description of tefviz and the parties of it, the nature of the right acquired by the mutasarrıf
10 Tasarruf in miri land, its principles accepted by the Land Law
