Course Objective

The aim of this course, to providing introduce the concepts and institutions of family law within framework the principle of the protection of the family in Article 41 of the Constitution and to explain of the resolutions about institution of marriage dissolution and against and prevention of problems faced, as a rule, in the stage of the divorce proceeding.

Learning Outcomes of the Course Unit

1   Be able to produce reasoned, critical and controversial opinions about the union of marriage, family concepts and protection of the marital relationship .
2   Be able to determine scientific studies, given the judicial evaluate decisions and legislation related to the provisions of the unity of marriage protection.
3   Be able to identfy the unity of the obligations of spouses and orders what depending on the consent of the spouse for protect the other one.
4   Be able to distinguish protective provisions about unity of marriage between Law No. 6284 what regulate Protection of Marriage Unity and Turkish Civil Code.
5   Be able to produce solutions of disputes that may arise in the protection of the unity of marriage.

1 Legal Nature of Unity of Marriage and Family Concepts, the relations between Unity of Marriage and Family Types, the Policies what helding Considerations for protection of Unity Marriage. Held Policy Relationship
2 The obligations of spouses; Legal Actions what Requiring the consent from other spouse.
3 The protective Provisins of Unity Marriage in Turkish Civil Code.
4 The different protective Provisins of Unity Marriage in Swiss Civil Code than Turkish Civil Code.
5 Concrete case study
6 The intervention of Judge to unity of Marriage, especially Exceptions about intervention of Judge may be prompted to unity of Marriage.
7 The precautions and their lagal nature about protection of unity of Marriage.
8 midterm exam
9 The precautions while living spouses together; to determine of one of the spouses Monetary Contribution for their livelihood, Abolition or Limitation of Authority to Represent in unity of Marriage; to take a child from Mother or father.
10 The precautions while Interrupting spouses; to determine the contribution of monetary, to arrange rules of Leveraging of housing and household equipment, the Management of Reception about spouses goods, to regulate to Relation with children.
11 The precautions while living together or interrupting; to order one of spouses borrowers; to act their debts to the other spouses, Limitation of Authority from one of the spouses, to transformation of Property Regime to the separation between the goods.
