Course Objective

The object of the course of Property Regimes is to learn the legal and optional property regimes which govern the relationships arising between the spouses due to their properties in the conjugal union; to be able to carry out the dissolution of the properties as per the property regime valid between the spouses under the former Civil Code and the Turkish Civil Code; to criticize the provisions related to the property regimes and generate solutions in accordance with the principles governing the property regimes.

Learning Outcomes of the Course Unit

1   Ability to describe the basic concepts of Property Regimes (legal property regime- optional property regime, property regime contract, extraordinary property regime, etc.), the history of the property regimes and the property regime systems applicable in different countries within the framework of the basic principles of property regimes (equality of spouses, principle of limited number, contracting freedom)
2   Ability to explain the provisions of the former Civil Code and the Turkish Civil Code.
3   Ability to make a correct decision as to what legal rule is to be applicable in the application of the legal rules related to property regimes to tangible events.
4   Ability to dissolve the property regime valid between spouses within the framework of the relevant legal rules.
5   Ability to criticize any existing legal regulations and decrees of the Supreme Court related to property regimes and generate proper solutions therefor.

1 General Information on Property Regimes (concept of property regime, principles governing the property regime law, Historical development of property regimes, property regimes valid in the legal systems of foreign countries)
2 Types of property regimes regulated in the Turkish Civil Code (legal property regime, contractual property regimes, extraordinary property regime), property regimes in the former Civil Code
3 Property regime contract
4 Legal property regime in the Turkish Civil Code: Participation in Acquired properties Regime: examination thereof in general (area, time, etc. of application)
5 Property groups: Acquired Properties, Personal Properties
6 Rights and Obligations of Spouses Related to Their Properties during the Validity of the Property Regime (Ownership, Management, Disposal)
7 Termination and Dissolution of the Participation in Acquired Properties Regime: Surplus Value Concept and Calculation Thereof: Values of the Acquired Properties of Spouses Which Fall into the Assets and Liabilities
8 Quiz Mid-term Exam
9 Claim and liability of value increase interest, claim and liability of equalization, values to be added
