Course Objective

In these years number of international relations have increased according to these the importance of international arbitration began to show itself. Parties of this kind of dispudes applies international arbitration rather than states courts. By applying international arbitration eliminates the hesitate about being objectivity and the dispute can be solved by the expert judges. The purpose of this lesson is to give information about the Turkish legal materials which regulates international arbitration and its scope.

Learning Outcomes of the Course Unit

1   to express the concept of arbitration in Turkish law
2   to identify the scope of the law of international arbitration.
3   to express the principles which applies procedure by arbitration
4   to give information about procedure by arbitration
5   to consider about recognition and enforcement of arbitral awards and the convention related to this issue called New-York Convention

4 Court of competent juristiction in procedure by arbitration
5 Arbitration agreement
6 Temporary injunction and provisional attachment
7 Election of arbiter
8 Midterm exam
9 Tre rules which may apply in procedure by arbitration and place of arbitration
10 To bring suit in arbitration and procedure by arbitration.
11 To take legal action against arbitration award
12 Cost of arbitration
13 The concepts of recognition and enforcement of arbitral awards, procedure by arbitration and provisions
14 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards
15 Recognition and Enforcement of Foreign Arbitral Awards in Turkey according to Turkish International Private and Civil Procedure Law
