Course Objective

The aim of the course is to provide students with general understanding of the basic concept of the contracts and torts law.

Learning Outcomes of the Course Unit

1   To learn concepts and institutions of contracts and responsibility law.
2   To determine problems arising from application of contracts and responsibility law.
3   To prevent and to solve the problems which may occur from the application of contracts and responsibility law.

1 - Introduction - Contracts and interpretation of the contracts
2 Terms & Conditions: Definitions and principles
3 Contractual Liability
4 - Obligations in tort - Tortious liability-Subject liability, Nofault liability - Unjust enrichement
5 Classification of contracts regulated by code of obligations and contracts which are not provided by code.
6 Sales contract: Definition, elements, movable and immovable sales contracts, and some types of sales
7 Responsibility of the seller for defects, in this context, the optional rights of the buyer against the provision of defective goods and services, especially within the scope of the Law on Consumer Protection I
8 Responsibility of the seller for defects, in this context, the optional rights of the buyer against the provision of defective goods and services, especially within the scope of the Law on Consumer Protection II
9 -Exchange contracts - Gift (Donation)
10 Contracts for the purpose of use: - Leasing contracts - Financial leaisng contracts - Loan contracts -
11 Contracts for the purpose of performing work: Employment contract; marketing contract; home service contract; artwork contract; representation contract; remittance transfer
12 Contracts aiming to provide assurance: Guarantee contract, pledge contract - Contracts securing personal guarentee
13 - Some anonymous contracts: Franchise agreement
