Course Objective

The purpose of the course is to draw a general portrait indicating the legislator's preferences for the current crime policy on crisis and disaster risks in the light of the special provisions of the Turkish Penal Code and to question this portrait, in terms of the law that should be in effect, by associating it with integrated disaster administration. It is planned to examine the functional relationship between integrated disaster administration and criminal law in the direction of stated purpose and to explain the existing links between crime types within the Turkish Penal Code and disaster and disaster risks by taking into account the disaster types.

1   To be able to explain the relationships between crime and crisis and disaster risk,
2   To be able to analyze the crime types leading to the actions related to causing disasters and/or disaster risks stated in the Turkish Penal Code,
3   To be able to explain the crimes regulated with the Law No.7269 on the Measures to be Taken and Aids to be Provided due to the Disasters Affecting Public Life,
4   To be able to make concrete suggestions, in terms of the law that should be in effect, regarding the criminal policy related to disaster and integrated disaster administration

Course Contents

Week Subject Description
1 The relationship between the basic concepts, criminal law and integrated disaster administration; classifying them by taking into account the disaster types according to the sources of the crime types stated in the Turkish Penal Code
2 Disaster Crimes (Regulations where the actions within the Turkish Penal Code and related to directly causing disasters and/or disaster risks are resolved as crime), For example, crimes of polluting the environment on purpose (TPC 181) and recklessly polluting the environment (TPC 182)
3 Risking the public safety on purpose (TPC 170), Recklessly risking the public safety (TPC 171), Emitting radiation (TPC 172)
4 Causing an explosion with the atomic energy (TPC 173), Possessing or transferring hazardous materials without permission (TPC 174)
5 Human Related Disasters, Large Population Movements, Migrations; Migrant Smuggling (TPC 79) and Crimes against humanity (TPC 77)
6 Disrupting the unity and territorial integrity of the state (TPC 302), Violating the Constitution (TPC 309), Crime against legislative authority (TPC 311), Armed rebellion against the government of the Republic of Türkiye (TPC 313)
7 Crimes of neglecting the duty related to mobilization (TPC 324) and Motivating others to oppose the law (TPC 217)
8 Midterm Exam
9 Regulations where the actions within the Turkish Penal Code and that might be closely related to causing disaster risks are criminalized; For examples, the crimes of hatred and discrimination (TPC 122) and causing shortage of items required by the public (TPC 238)
10 Crimes, stated in the Turkish Penal Code, that are regulated as the aggravating conditions for the crime in case that the actions that may lead to directly causing disasters and/or disaster risks: Qualified act of intentional killing (TPC 82, 1/c), Qualified theft (TPC 142, 1/d), Qualified damage to property (TPC 152 1/b, 1/d, 2/a, 2/b, 2/c)
11 The crime, stated in the Turkish Penal Code, regulated as taking advantage of disorder resulting from a natural disaster: Qualified theft (TPC 142, 2/c)
12 Crimes and misdemeanors regulated with the Law No.7269 on the Measures to be Taken and Aids to be Provided due to the Disasters Affecting Public Life
13 Criticism of crime types and proposals on crime policy in terms of disaster administration
