Course Objective

Considering, discussing and interpreting of existing international rules applicable during armed conflicts when human rights are in danger; determining rights and obligations of the parties of armed conflicts; evaluating the process for the enforcement of sanctions in case of breach of rules in armed conflicts; and determining the legal framework for the protection of victims of armed conflicts.

Learning Outcomes of the Course Unit

1   To be able to explain the concept of armed conflict and its types
2   To be able to interpret the basic treaties, customary rules and general principles of law included in law of armed conflict
3   To be able to specify the process to be applied in case of violation of the law of armed conflict
4   To be able to specify the rights of victims of an armed conflict and the process followed in the event of violation of these rights
5   To be able to recognize current problems in the context of international humanitarian law
6   To be able to evaluate current events in the context of international humanitarian law

2 Basic features of the law of armed conflicts, its sources
3 Types of armed conflicts
4 Legal situation with regard to the conduct of armed conflicts, combatants and non-combatants
5 The means and methods of armed conflicts
6 The protection of people, goods and the environment in armed conflicts
7 Interruption and termination of armed conflicts and the legal situation
8 Exam
9 Responsibility of states and international organizations in armed conflicts
10 Responsibility of persons due to armed conflicts, types of crime
11 Prosecution and punishment of offenders in international criminal law (Nuremberg and Tokyo International Military Tribunals)
12 The prosecution and punishment of offenders in international criminal law (The former Yugoslavia and Rwanda International Criminal Tribunals)
13 International Criminal Court, formation, characteristics, jurisdiction
14 Case studies of the practice of the International Criminal Court
