Course Objective

The aim of this course is to inform the students about the customs crimes and penalties related to customs crimes and penalties and to inform the students about the regulations about the customs and formal duties related to foreign trade. In Customs Criminal Law course, the elements of customs misdemeanors and smuggling crimes, identification, monitoring and trial are discussed, the problems encountered and their solutions are also discussed. Students who want to do academic research and study in this field are given guidance on theory and practice.

Learning Outcomes of the Course Unit

1   To be able to determine the place of customs misdemeanors and smuggling crimes in tax law and punishment system.
2   To be able to distinguish the customs misdemeanors from smuggling crimes.
3   To be able to determine the implementation of the general provisions of the Turkish Penalty Code and the Misdemeanors Code with respect to the customs misdemeanors.
4   To be able to explain the elements of customs offenses and misdemeanors
5   To be able to apply the rules on investigation phase and prosecution phase in judicial jurisdiction in smuggling crimes
6   To be able to apply administrative remedies and judicial remedies against customs misdemeanors

9 Introduction to the Anti-Smuggling Law and the implementation of the Turkish Penalty Code in terms of smuggling crimes

11 Sanctions of smuggling crimes
12 Effective cases of smuggling crimes
