Course Objective

The aim of course; to introduce basic concepts and institutions of healt law and to provide their relations with private law especially the principles of liability law.

Learning Outcomes of the Course Unit

1   Be able to explain Health-related public and private structures, their duties, tasks and responsibilities.
2   Be able to determine scientific studies, given the judicial decisions and legislations on the health law.
3   Be able to identify Patient Rights, within the framework of regulations and their implementation shortcomings and missing aspects of the legal structure.
4   Be able to producethe resolution of disputes of treatment contracts within framework of their legal nature, the structure of the parties and definitions.
5   Be able to distinguish the duties and obligations between Doctors and other health professionals.
6   Be able to determine other health professionals liability.

Course Contents

Week Subject Description
1 Definition and Scope of Health Law, Health Law and Concepts of Medical Law, The Place of Health Law in Other Law Branches.
2 Health Law Resources, Basics regulations about Health Law.
3 Definition of Treatment Contract and their Legal Nature and Elements.
4 Doctor's Obligations; Diagnosis, Selecting the appropriate treatment method, Lighting the patient, Gaining the patient's acceptance, Due diligence, controlling the patient after treatment.
5 Obligations of the patient; comply with the rules of Service Institutions, giving the correct information, comply the the recommendations of doctors, Establishing a Dialogue constructive and positive, fee Payment.
6 The Types of Medical Intervention, Diagnostic and Therapeutic Interventions, on organ and tissue transplantation Interventions, Interventions for Cosmetic, treatment Activities with Pharmaceutical.
7 Concrete case study.

10 Institutions and organizations that provide health services; Legal Responsibility of the hospitals.
11 Description of Patient's Rights, Patient's Rights on the International Documents.
12 Patient's Rights Legislation on Turkish Law.
13 Utilization of health services, Freedom of Information about health status and Right of medical processing with Permits and Approval..
14 Patient's Rights in Medical Research; Protection and Disclosure of volunteer, the form of consent of the volunteer and to use Pharmaceutical within framework Research. -The responsible authorized Persons on the perspective of Patient's Rights and applicable Legal Ways in Case of Violation.
