Course Objective

The aim of course; to give to the students at the undergraduate level informations about real rights and their patency what providing with possesion and land registry instituons. The course also puting on a dispositions rules, what based prior year in the law of abligations course, especially to provides unjust enrichment rules, that is the one of course of Obligations. In addition this course serving as the infrastructure in many areas for example Civil Procedure Law and Execution and Bankruptcy Law.

Learning Outcomes of the Course Unit

1   Be able to determine definitions, types, contents and prevailling principles of real rights.
2   Be able to determine possesion and land registry instutions and their functions, results and prevailing principles.
3   Be able to examination scientific studies, given the judical decisions and legislation in Property Law.
4   Be able to identfy problems that may have emerged in the field of Property Law.
5   Be able to analyze problems of property law lights of prevailling principles from possession and land registry.
6   Be able to produce critical and controversial opinions in the field of property law.
7   Be able to improve learning, learn skills and thinking in the field of property law.
8   Be able to transfer the opinions about law of property to the others as oral and written.

1 General information about the purpose and content of course; providence the method of processing about the course and plan; giving to materials about processing of course.
2 Definition and importance of Property Law; Conception of object and arts of object
3 Induction of rights in rem and difference of them from rights against person and also strengthened ones.
4 Subject and arts of the rights in rem, principles about rights in rem
5 Consept of possession and its arts
6 Acquirement of possession, loss of possession
7 Chattel ownership and it s relation to acquirement of possession
8 Protection of possession
9 Presumptions arised possession
10 Meaning, importance and elements of the land register
11 Principles about the system of the land register
12 Recording of immovable property in the land register, espacially cadaster
13 Land registry transactions
14 Land register entries correction of unwarrented entries
15 First Midterm Exam
16 Nature and protection of ownership
17 Scope of ownership (constituent parts and accessories)
18 Collective ownership, joint ownership
19 Co-ownership
20 The acquisition of land ownership with registration
21 The acquisition of land ownership without registration
