Course Objective

Law No. 5718 on International Private and Procedural Law (IPPL) and international conventions to which Türkiye is a party contain provisions on the protection of the child. In disputes arising from family disputes with foreign elements, the child is protected through these regulations. The aim of the course is to examine these regulations on the protection of the child, to determine the problems arising from the practice and to form an idea about their elimination.

Learning Outcomes of the Course Unit

1   Determining the importance of child protection in private international law
2   Determination of the concept of best interest of the child
3   Examination of the provisions on the protection of the child in the Law on International Private and Procedural Law
4   Examination of international conventions to which Türkiye is a party on the protection of children
5   Determining the international effect of measures for the protection of the child
6   Determining the importance of the immediate return of the abducted child to his/her habitual residence

5 Evaluation of the provisions of "International Private Law and Procedural law" on the protection of the child
6 Determination of international conventions that provide protection of the child under international private law
7 UN Convention on the Rights of the Child
8 European Convention for the Protection of the Rights of the Child
9 Protection of the child under the Hague Convention on the Civil Aspects of International Child Abduction
10 Evaluation of the scope of the child abduction convention and its provisions protecting the child
11 Evaluation of case studies on the abduction of a child from the country of habitual residence
12 Protection of the child under the Hague Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Co-operation in Respect of Parental Responsibility and Measures for the Protection of Children
13 Evaluation of the scope of the child protection convention and its provisions protecting the child
14 Evaluation of the problems arising from the recognition and enforcement of measures for the protection of children
