Course Objective

This course is designed for law graduates to enhance their academic legal knowledge concerning Turkish juvenile system and juvenile justice systems in other jurisdictions. The course will be delivered in accordance with U.N. Convention on the Rights of the Child, and developments in the context of Turkish juvenile system will be explained to students. The course will give the students the skills and knowledge about specific rules that are applied to juveniles in criminal and criminal procedure law and also at sentencing and probation stages.

Learning Outcomes of the Course Unit

1   To learn how to implement and interpret the rules of juvenile justice in accordance with the U.N Convention on the Rights of the Child.
2   To learn in accordance with their psycological and social decision making capacity, how to involve children in all decision making process in criminal investigation and to understand how to set up a mechanism that takes in to account the decision making capacity of children during all judicial orders including arrest and detention.
3   To provide necessary skills for students to understand in all actions concerning children, whether undertaken during sentencing, prisoning or probation stages, the best interests of the child shall be a primary consideration.
4   To understand the importance of consistency between the rules of Turkish juvenile justice system that are applied in criminal and criminal procedure law and the fundamental principles of juvenile justice.
5   To understand the importance of providing the opportunity for the child to be heard and act in accordance with his/her views in any judicial proceedings affecting the child,
6   To learn how to inform children about their right to express their views freely in all matters affecting them and how to guarantee this right during prison services.
7   To understand the importance of setting up a multi -disciplinary system that facilitates criminal investigation involving juveniles and applies arrest and detention as the last resort

1 Week-1 Information on course content, methodology, providing the reading list, how to use and access to relevant legal and research databases.
2 Week-2 Development in juvenile justice systems in Türkiye and other jurisdictions.
3 Week-3 Child rights and its development
4 Week-4 The Beijing Rules and the Fundamental Principles of the UN Convention on the Rights of the Child.
5 Week-5 Fundamental principles of Juvenile Justice System.
6 Week-6 Juvenile Courts
7 Week-7 Protection and Support Orders for Children
8 Week-8 Specific rules concerning children in criminal law.
9 Week-9 Specific rules concerning children in criminal procedure law.
10 Week-10 Specific rules concerning children in prison services and probation.
11 Week-11 Disciplinary actions and measures that can be taken against children
12 Week-12 Discussion of case law and the examples of best practices.
13 Week-13 Juvenile police and criminal investigation offices.
14 Week-14 Example of best practices, assessment of future needs, recommendations and solutions for specific problems.
