Course Objective

To learn the subject and basic concepts of intellectual property law. Distinguishing intellectual property rights. To be able to understand the characteristics, functions and ways of protection bye distinguishing intellectual property rights from each other. This course aims to explain how and why state interventions are set forth by competition policies and drafted competition acts and restrictions in order to constitute an open market which provides maximum benefit for consumers and social welfare, competitors as well.

Learning Outcomes of the Course Unit

1   To be Able to identify the types of intellectual property rights, to distinguish them from each other and to comprehend their functions
2   Determining how to protect intellectual property rights in case of attack and what are the ways to protect them
3   To be able to explain trademarks, patents, models, designs, geaographical indications, ideas and works of art with examples to show their functions
4   To state the reasons (aims) and scope of the legal instruments of competition law
5   To state competition theories; how competition is prevented, restricted or distorted
6   To understand the meaning of agreements, decisions and practices preventing, restricting or distorting competition
7   To determine why an exemption regime has been regulated and to explain the types and conditions of exemption
8   To explain the meaning of abuse of dominant position and to state the elements (forms) of dominant position

Course Contents

1 Introduction to intellectual property law, general information about intellectual property rights, general scope of industrial property law- conceptual studies
2 Definition of the trademark, sign that can be a trademark , registration of the trademark and use of the trademark
3 Invalidity of the trademark and lawsuits that can be filed in case of trademark infringement and claims that can be made
4 General information about patent law, comparison with utility model
5 Protection of patent rights and lawsuits that can be filed in case of attack
6 Design and geographical indication
7 Intellectual and artistic works law-Copyright
8 Basic information on competitions law as a subsisary field of economics law
9 The aim of the protection of competition, resources and scope of the competition rules
10 Prohibition of cartelization and other forms of restricting competition; conditions for any prevention
11 Agreements, decisions and practices limiting competition between undertakings
12 Doctrinal interpretation of some concepts: prevention, restriction, distortion of competition, aim and effect of such agreement, decision or practice
13 Concept of exemption, reasons for an exemption regime. Conditions of individual and block exemptions
14 Concept and conditions of abuse of dominant position, restrictions on prohibition of abuse of dominant position
